Definitions

Golflounge Den Haag: Golflounge Den Haag BV, located in The Hague.

Customer: the person with whom Golflounge Den Haag has entered into an agreement.

Parties: Golflounge Den Haag and customer together.

Consumer: a customer who is also an individual and who acts as a private person.

Applicability of general terms and conditions

These terms and conditions apply to all quotations, offers, work, orders, agreements and deliveries of services or products by or on behalf of Golflounge Den Haag.

Parties may only deviate from these terms and conditions if they have expressly agreed to do so in writing.

The parties expressly exclude the applicability of additional and/or deviating general terms and conditions of the customer or third parties.

House rules

To ensure safety, quality, and atmosphere within Golflounge Den Haag, the following house rules apply to all visitors.

Every visitor must adhere to the instructions of Golflounge Den Haag employees.

Golflounge Den Haag reserves the right to refuse entry or remove visitors from the premises if they:

• behave aggressively, disruptively, or disrespectfully

• being under the influence of alcohol or drugs

• causing damage to property

• bothering other guests or employees

• not adhering to the house rules or safety instructions

Visitors must take careful care of the facilities, golf clubs, simulators and other equipment of Golflounge Den Haag.

It is not permitted to bring your own food and drinks without permission from Golflounge Den Haag.

The use of the golf simulators and other sports facilities is at your own risk.

Golflounge Den Haag is not liable for loss, theft, or damage to visitors' personal property.

Alcohol policy

Golflounge Den Haag serves alcohol in accordance with the Alcohol and Catering Act (Alcohol Act).

Alcohol is only served to guests aged 18 and over. Golflounge Den Haag may ask visitors to identify themselves.

Golflounge Den Haag reserves the right not to serve alcohol to persons who:

• be younger than 18 years old

• visibly under the influence of alcohol or drugs

• to behave inappropriately or disruptively

Visitors are not allowed to bring their own alcoholic beverages to Golflounge Den Haag.

Employees of Golflounge Den Haag are authorized to refuse the sale of alcohol if they deem this necessary for the safety or order of the location.

Cancellation policy

Reservations at Golflounge Den Haag can be cancelled free of charge up to 48 hours before the reserved time.

In case of cancellation between 24 and 48 hours before the start of the reservation, Golflounge Den Haag may charge 50% of the reservation amount.

In case of cancellation less than 24 hours before the start or in case of a no-show, Golflounge Den Haag reserves the right to charge 100% of the reservation amount.

Different cancellation conditions may apply for group bookings and events, which must be agreed in writing in advance.

Use of sports facilities and liability

The use of the golf simulators, golf clubs and other sports facilities at Golflounge Den Haag is entirely at your own risk.

Visitors must use the facilities in a safe and responsible manner and follow the instructions of Golflounge Den Haag employees.

Golflounge Den Haag is not liable for injuries, bodily harm, or other damage that occurs during the use of the facilities, unless there is intent or gross negligence on the part of Golflounge Den Haag.

Visitors are responsible for any damage they cause to equipment, facilities, or property of Golflounge Den Haag or third parties.

Golflounge Den Haag may deny access to the facilities to visitors who do not comply with safety instructions or house rules.

Offers and quotes

Offers and quotations from Golflounge Den Haag are without obligation, unless expressly stated otherwise.

An offer or quotation is valid for a maximum of 1 month, unless a different acceptance period is stated in the offer or quotation.

If the customer does not accept an offer or quotation within the applicable period, the offer or quotation will lapse.

Offers and quotations do not apply to repeat orders, unless the parties have expressly agreed otherwise in writing.

Acceptance

Upon acceptance of a non-binding offer or quotation, Golflounge Den Haag reserves the right to withdraw the offer or quotation within 3 days of receipt of acceptance, without the customer being able to derive any rights from this.

Oral acceptance by the customer only binds Golflounge Den Haag after the customer has confirmed this in writing (or electronically).

Prices

All prices used by Golflounge Den Haag are in euros, including VAT and excluding any other costs such as administration fees, levies, and travel, shipping, or transportation expenses, unless expressly stated otherwise or otherwise agreed.

Golflounge Den Haag may change all prices it uses for its services, on its website or otherwise made known, at any time.

The price for a service is determined by Golflounge Den Haag based on the actual hours spent.

The price is calculated according to the usual hourly rates of Golflounge Den Haag, applicable for the period in which work is carried out, unless a different hourly rate has been agreed.

If the parties have agreed on a total amount for a service, this is a guideline price unless a fixed price has been expressly agreed.

Golflounge Den Haag is entitled to deviate up to 10% from the target price.

If the target price is more than 10% higher, the customer will be informed of this in a timely manner.

Golflounge Den Haag reserves the right to adjust prices annually. Prior to these changes, Golflounge Den Haag will notify customers.

The consumer has the right to terminate the agreement if he does not agree with the price increase.

Payments and payment terms

When entering into the agreement, Golflounge Den Haag may request a deposit of up to 100% of the agreed amount.

The customer must make subsequent payments within 14 days after delivery.

Payment terms are considered deadlines. This means that if the customer has not paid by the last day of the term, they are automatically in default.

Golflounge Den Haag reserves the right to make delivery dependent on immediate payment or to demand security.

Consequences of not paying on time

If the customer does not pay on time, Golflounge Den Haag is entitled to charge statutory interest and collection costs.

The collection costs are calculated in accordance with the Decree on compensation for out-of-court collection costs.

In addition, Golflounge Den Haag may suspend its obligations until the customer has fulfilled his payment obligation.

In the event of bankruptcy, seizure or suspension of payments, all outstanding claims are immediately due and payable.

Right of withdrawal

A consumer can cancel an online purchase within 14 days without giving any reason, unless it concerns:

• services related to catering, leisure or events

• services that are performed entirely within the cooling-off period with the customer's consent

• emergency repairs

• bets or lotteries

Right of suspension

Unless the customer is a consumer, the customer waives the right to suspend the fulfillment of obligations.

Settlement

Unless the customer is a consumer, the customer waives the right to offset a debt to Golflounge Den Haag against a claim on Golflounge Den Haag.

Warranty

When parties have entered into an agreement with a service-oriented nature, this contains an obligation of best efforts for Golflounge Den Haag and not an obligation of results.

Execution of the agreement

Golflounge Den Haag will execute the agreement to the best of its knowledge and ability.

Golflounge Den Haag has the right to have work (partially) carried out by third parties.

The agreement will be implemented in consultation and after payment of any advance payment.

Confidentiality

The customer will keep all information received from Golflounge Den Haag confidential.

This confidentiality obligation applies during the agreement and for 3 years after its termination.

Liability Golflounge The Hague

Golflounge Den Haag is only liable for damage directly resulting from intent or deliberate recklessness.

Golflounge Den Haag is not liable for indirect damage, such as:

• consequential damage

• lost profits

• missed savings

• damage to third parties

If Golflounge Den Haag is liable, liability is limited to the amount paid out by the liability insurance.

Complaints

The customer must report a complaint as soon as possible, and at the latest within 1 month.

Consumers must report complaints within 2 months.

Force majeur

Golflounge Den Haag is not liable if obligations cannot be fulfilled due to force majeure, including but not limited to:

• electricity or internet disruptions

• strikes

• government measures

• extreme weather conditions

• malfunctions in systems or equipment

If a force majeure situation lasts longer than 30 days, either party may terminate the agreement.

Changes to the general terms and conditions

Golflounge Den Haag may change these general terms and conditions.

Important changes will be discussed with the customer in advance as much as possible.

Consumers may cancel the agreement in the event of substantial changes.

Applicable law and competent court

All agreements are exclusively governed by Dutch law.

Disputes will be submitted to the competent court in the district of The Hague, unless the law prescribes otherwise.
